Receiving an overseas inheritance can be a long and complicated process for families or relatives living in different countries. Inheriting in Japan

In Japan, inheritance begins upon the death of an individual, and the surviving heirs will not only inherit his/her assets but also his/her liabilities as well. Legally, heirs are allowed to make a decision within 3 months. They can either “accept the assets and liabilities”, “disclaim them,” or “accept them conditionally.” In case the heirs decide to “accept”, they will inherit all the assets as well as liabilities without any restrictions.

Who are the heirs/inheritors according to Japanese Law?

According to the law, an heir is an individual who receives rights, claims and obligations upon a death or disappearance of an ancestor. A legal heir is the spouse, a lineal ascendant (parent, grandparent), a lineal descendant (child, grandchild) and a sibling of the deceased. Besides the spouse and relationship by adoption, the heir is limited to a person related to the deceased by blood.

Inheritance Procedure

Since leaving a last will and testament is not a common practice in Japan, most of the people die intestate. Therefore, the surviving heirs have to prepare a legal document called an “Estate Division Agreement” to proceed with the inheritance process.

What is the Estate Division Agreement?

An Estate Division Agreement is a document that reflects the decision of the heirs regarding the division of the estate of the ancestor or decedent. It needs to be signed and affixed with seals of all the heirs.
The agreement should state the following:

  • State who will inherit what part of the decedent’s estate;

  • State immovable properties as they appear in the registration records;

  • State the process of how new assets or liabilities will be handled should they be found after the agreement is signed and sealed by each heir;

  • Signed and affixed with a seal of each heir. Each heir is given a copy of this agreement.

 

Inheritance Tax in Japan

The Japanese civil code stipulates who and how much a person is allowed to inherit. Inheritance tax determines the tax rate for the inherited estate. There are 3 objectives for the inheritance tax.

  1. To prevent excessive concentration of wealth and help its redistribution in the society

  2. Impose a tax on unearned income or effortless gains

  3. Review the alleviation of the burden incurred by tax benefits the decedent received in life

Respecto a heredar bienes en Japón

En Japón recibir una herencia significa hacerse cargo tanto de los bienes como de las deudas que tenía la persona que falleció.
Al fallecer una persona se inicia el proceso hereditario. A partir del día en que reciben la notificación correspondiente, los herederos tienen un plazo de 3 meses para “Aceptar ser heredero” “Renunciar” o “Aceptar ser legatario”
El aceptar significa hacerse cargo de por vida, tanto de los aspectos favorables como de los desfavorables de esta herencia.

Respecto a los herederos legítimos

Se llama heredero a quien se hará cargo de los derechos, obligaciones, deudas de la persona que ha fallecido o desaparecido y que pasará a llamarse causante. Los herederos legítimos son la esposa/o del fallecido/a, descendientes directos línea ascendente (padres, abuelos) descendientes directos línea descendente (hijos, nietos) hermanos y/o hermanas y fuera de su esposa/o, si no hubiera un pacto de adopción, los herederos se limitan a los descendientes consanguíneos.

Respecto a trámites herenciales

Como en Japón no es usual dejar testamento, es necesario elaborar un Acta de Partición de Bienes Herenciales.

Respecto al Acta de Partición de Bienes Herenciales

El Acta de Partición de Bienes Herenciales, se elabora bajo el acuerdo de todos los herederos, para determinar como serán repartidos los bienes. La misma deberá ser firmada por todos los herederos. Los herederos que están en Japón, además de firmar deberán sellar y presentar el certificado del sello (Inkan shoumeisho), los herederos que vivan en el extranjero, deberán firmar y autenticar la firma ante un escribano/notario público. Este documento sólo tendrá validez si es firmado por todos los herederos.

  • Se deberá especificar quién y que bienes heredará.

  • Si posteriormente se descubren nuevos bienes, se deberá asentar y dejar en claro qué hacer con ellos.

  • El Acta de Partición una vez firmada, sellada y con los correspondientes certificados adjuntos, serán entregados a cada uno de los herederos para su archivo.

 

Impuestos a la herencia en Japón

Según el Código Civil de Japón, quiénes son los herederos y qué bienes les corresponde heredar están determinados por ley, al igual que el impuesto a la herencia. El impuesto a la herencia tiene 3 objetivos:

  1. Suprimir la excesiva concentración de riqueza y redistribuirla a la sociedad.

  2. Gravitar bienes obtenidos gratuitamente.

  3. Volver a verificar la reducción de la carga debida a beneficios fiscales de bienes legados en vida
